1. Introduction
Welcome to Businessclaud (“we,” “us,” or “our”). We are committed to providing high-quality products and a seamless shopping experience. This Refund Policy outlines your rights and our obligations regarding returns, refunds, and exchanges for purchases made through our e-commerce platform.
By placing an order on our website, you agree to be bound by this Refund Policy, as well as our Terms of Service and Privacy Policy. This policy complies with applicable Kenyan laws, including but not limited to the Consumer Protection Act, No. 46 of 2012, the Sale of Goods Act (Cap 31), and the Electronic Transactions Act, No. 2 of 2011.
If you have any questions about this policy, please contact us at support@businessclaud.com .
2. Eligibility for Refunds
Businessclaud offers a 7-day refund window from the date of delivery of your order. To be eligible for a refund, the following conditions must be met:
- The request for a refund must be submitted within 7 calendar days of the delivery date.
- The product must be unused, undamaged, and in its original packaging, including all tags, labels, accessories, and documentation.
- Proof of purchase (e.g., order confirmation email or invoice) must be provided.
- The product must not fall under the list of non-refundable items (see Section 4).
Failure to meet any of these conditions may result in the rejection of your refund request.
3. How to Request a Refund
To initiate a refund, please follow these steps:
- Log in to your Businessclaud account.
- Navigate to “My Orders” and select the order containing the item(s) you wish to return.
- Click “Request Return” and select “Refund” as the reason.
- Provide a brief explanation and upload clear photographs of the product (if requested).
- Submit your request.
Alternatively, you may email us at support@businessclaud.com with the following information:
- Full name
- Order number
- Product name(s) and reason for return
- Delivery date
- Contact phone number
Once your request is received, our customer service team will review it within 2 business days and notify you of approval or rejection.
4. Non-Refundable Items
The following items are not eligible for refunds under any circumstances, unless they are defective, damaged upon delivery, or delivered in error by Businessclaud:
- Digital products (e.g., downloadable software, e-books, digital licenses)
- Personalized or custom-made items
- Perishable goods (e.g., food, flowers)
- Intimate or sanitary items (e.g., underwear, swimwear, earrings)
- Gift cards or promotional vouchers
- Products marked as “final sale” or “clearance”
- Products that are in good condition
This exclusion is in line with Section 38 of the Consumer Protection Act, which permits reasonable limitations where goods are of a nature that resale would be unhygienic or impractical.
4.1 No Refunds for Price Regret or Post-Purchase Price Comparisons
Businessclaud does not issue refunds, returns, or exchanges solely on the grounds that:
- The customer has changed their mind about the purchase;
- The customer later discovers a lower price for the same or a similar product on our website, a competitor’s site, or any other platform;
- The customer regrets the purchase after confirming the order, provided the product was accurately described, correctly priced at checkout, and delivered as agreed.
At the time of purchase, all prices are clearly displayed on the product page and confirmed during checkout. By completing the transaction, you acknowledge that you have reviewed and accepted the final price, product details, and terms of sale.
Please note: This policy does not override your statutory rights under Kenyan law. If a product is defective, not as described, or delivered in error by Businessclaud, you remain entitled to a remedy (repair, replacement, or refund) under the Consumer Protection Act (2012), regardless of price considerations
5. Refund Processing Timeline
Once your return is approved:
- You will receive instructions on how and where to ship the product back to us.
- You are responsible for return shipping costs unless the return is due to our error (e.g., wrong item sent, defective product).
- Upon receipt and inspection of the returned item (within 3 business days), we will process your refund.
- Refunds will be issued to the original payment method within 5–7 business days.
Please note: Bank processing times may vary depending on your financial institution.
6. Refund Amount
Refunds will generally cover:
- The full purchase price of the eligible product(s)
- Any applicable taxes paid
However, the following deductions may apply:
- Original shipping fees (non-refundable unless the return is due to our error)
- Return shipping costs (if borne by the customer)
- A restocking fee of up to 10% may be applied for bulky or high-value items, where justified by handling and restocking costs (in compliance with fair practice under the Consumer Protection Act).
No refund will be issued for partial use or damage caused by the customer.
7. Exchanges
If you wish to exchange an item for a different size, color, or model, please indicate this in your return request. Exchanges are subject to product availability.
- If the new item is of lower value, the difference will be refunded.
- If the new item is of higher value, you will be asked to pay the difference before the exchange is processed.
Exchanges follow the same 7-day eligibility window and condition requirements as refunds.
8. Legal Compliance – Kenyan Consumer Rights
Businessclaud adheres to all relevant consumer protection laws in the Republic of Kenya:
8.1 Consumer Protection Act (2012)
- Section 37: Consumers have the right to receive goods that are of satisfactory quality, fit for purpose, and as described.
- Section 38: Consumers may return goods within a reasonable time if they do not conform to the contract of sale.
- Section 43: Prohibits unfair contract terms and ensures transparency in return and refund policies.
8.2 Sale of Goods Act (Cap 31)
- Implies conditions of merchantability and fitness for purpose.
- Grants buyers the right to reject goods that do not meet contractual descriptions.
8.3 Electronic Transactions Act (2011)
- Requires e-commerce businesses to provide clear, accessible, and unambiguous terms, including refund policies (Section 23).
- Mandates that consumers be able to review and correct errors before finalizing online transactions.
Businessclaud ensures that this Refund Policy is publicly accessible, written in plain language, and does not contain hidden clauses that undermine consumer rights.
9. Dispute Resolution
In the event of a dispute regarding a refund:
- We encourage direct communication with our customer support team to resolve the matter amicably.
- If unresolved within 14 days, you may escalate the issue to the Kenya Consumer Protection Advisory Committee (CPAC) or file a complaint with the Competition Authority of Kenya (CAK).
- As a last resort, disputes may be referred to the Small Claims Court under the Small Claims Court Act (2016), which provides a fast-track, low-cost resolution mechanism for consumer claims under KES 1 million.
Businessclaud commits to cooperating fully with any regulatory investigation or mediation process.
